Many of these cases are being heard in Cobb County Superior Courts in historic downtown Marietta and Mariatta Square. The DUI misdemeanor cases are assigned to a courtroom at the same time as a DUI case is heard. However, a trial attorney can request that a DUI criminal case be heard in another courtroom, such as Fulton County Superior Court. If the jury asks Mariety to stand trial, he will request that the case be referred to Cobb County State Court and then to the Atlanta County Court of Criminal Justice.

If you are charged with a misdemeanor and request a jury trial, you can be transferred to Cobb Superior Court on request. If your traffic ticket or other misdemeanor require a trial by jury, Cobb County State Court is where all misdemeanors go to trial.
The Cobb County State Court handles DUI and misdemeanor cases stemming from the unincorporated parts of Cobb County. The Atlanta court is handling DUI cases, but not all. The state courts in Athens, Cobb, DeKalb, Fulton, Gwinnett, Macon and Fulton Counties, and Cobb Superior Court.
The Cobb County Supreme Court is considering the above cases because Georgia's Constitution prohibits state courts from handling criminal cases. Criminal cases for misdemeanors handled in Cobb County State Court include arrests made in none of the six communities. This includes cases of offences in which an arrest was not made in one or all six of these communities, but only in the type of case referred to above. The criminal case for misdemeanor in the state court in Atlanta, Georgia's largest city, is included in the case being handled in the state court in Atlanta.
So anyone who can't resolve a plea deal for a crime other than DUI will be taken to state court in Atlanta, where a trial with six jurors is taking place, bound and forgotten. So those who can't resolve the felony cases that cannot be tried with DUI are heading to a Georgia state court, where there are six jury trials.

Because Georgia's Constitution prevents state courts from hearing criminal cases for crimes, the Cobb County, GA Supreme Court does not handle the above cases, as the state courts do.
